Ormanlarımızı kesiyor, tatlı su akiferlerimizi tüketiyor ve hayati önem taşıyan topraklarımızı kaybediyoruz. Okyanuslarımızdaki yaşamı sıyırıp yerine yüz milyonlarca ton plastik atık koyuyoruz. Çevremizi toksik endüstriyel kimyasallarla dolduruyoruz. Kirliliğimiz, kıtalardaki yaşamın dokusunu parçalayan ısı dalgalarına, kuraklıklara ve vahşi yangınlara neden olan iklim değişikliğini tetikliyor. Ve dünyaya yeni nesiller getiriyoruz, onurlu bir varoluşun kaynaklarına erişmeye ihtiyaç duyan milyonlarca insan. Hayata yönelik tehditlerin kapsamı ve genişliği her geçen gün artmaktadır. Nous enlevons la vie de nos océans et la remplaçons par des centaines de millions de tonnes de déchets plastiques. Nous inondons notre environnement de produits chimiques industriels toxiques. Notre pollution est à l'origine du changement climatique qui provoque des vagues de chaleur, des sécheresses et des incendies de forêt qui (...) déchirent le tissu de la vie sur les continents. Et nous mettons au monde de nouvelles générations, des millions qui ont besoin d'accéder aux ressources d'une existence digne. La portée et l'ampleur des menaces à la vie augmentent jour après jour. Ce n'est pas un mode de développement durable. La cause profonde de nos maux provient d'une façon de penser erronée. Qu'est-ce que cela signifie exactement? cela signifie que nous nous considérons principalement comme des êtres matériels, tout en niant notre nature spirituelle. THOMPSON University of St. Thomas St. Paul, Minnesota Introduction I N HIS Three Rival Versions of Moral Enquiry1 Alasdair Macintyre continues (with certain modifications) in a similar trajectory established in two earlier works, After Virtue and Whose Justice? Which Rationality? Against postEnlightenment portraits of moral reasoning, he consistently defends a conception of practical rationality which entails the (...) recognition of tradition, authority, and narrative as constitutive components of any rationally determined moral enquiry. Despite the consistent appeal to tradition, there is a significant development within Macintyre's reflections regarding the pre-eminent resources we are to draw upon. At the end of After Virtue we are asked to await a "doubtless very different" St. Benedict. In Whose Justice? Which Rationality? the Thomistic tradition emerges as the superior form of moral enquiry. While Thomism maintains a pre-eminence in Three Rival Versions of Moral Enquiry, I suggest that there is an increasingly Augustinian element emerging within his analysis and that this dimension underlies Macintyre's efforts in ways not previously specified. THOMPSON That Augustine figures in Macintyre's reception of the Thomistic tradition is not necessarily striking, for part of what fuels Macintyre's increasing enthusiasm for St. Thomas is precisely the latter's capacity to draw upon the best of the Augustinian tradition of enquiry. Beyond what Macintyre himself has overtly recognized as Augustine's contribution to the thought of St. Thomas, however, I suggest that elements of Augustine's thought directly influence much of Macintyre 's own attempts at restoring a kind of tradition-guided enquiry. This Augustinian strain, moreover, not only serves to highlight features of Macintyre's analysis of Thomism, but also brings to light certain theological presuppositions essential to the kind of moral enquiry Macintyre hopes to retrieve. The character of Macintyre's narrative, then, leads us to St. Augustine. In After Virtue it is largely the Aristotelian tradition of enquiry which he defends against rival post-Enlightenment theories of morality. He argues that the analytic, linguistic, and phenomenological tools brought to bear upon the task of formulating a coherent conception of the moral life and moral enquiry have failed miserably, principally for two reasons. The first is that such contemporary efforts have neglected to realize that moral enquiry is embedded in a broader context of social practices, practices which are inevitably historically conditioned; thus a failure to recognize the historically situated character of moral enquiry distorts that account. The second reason is related to the first in that failure to acknowledge the historical character of such enquiry has resulted in a failure to recognize that much of our contemporary terms and tools of moral analysis are remnants from previous contexts of enquiry which are no longer mutually agreed upon nor recognized as relevant.' What has been lost, among other things, is the teleological metaphysics which serves as the context for nearly two millennia in the West. A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. O presente artigo pretende precisamente revisar a natureza iusfundamental do consentimento informado a partir da obra de W.N. Hohfeld e Robert Alexy. (shrink)

Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. PREMISSA No século XIX, ocorreram transformações impulsionadas pela emergência de novas fontes energéticas (água e petróleo), por novos ramos industriais e pela alteração profunda nos processos produtivos, com a introdução de novas máquinas e equipamentos. Depois de 300 anos de exploração por parte das nações europeias, iniciou -se, principalmente nas colônias latino-americanas, um processo intenso de lutas pela independência. É no século XIX, já com a consolidação do sistema capitalista na Europa, que se encontra a herança intelectual mais próxima da (...) qual surgirá a Sociologia como ciência particular. No início desse século, as ideias do Conde de Saint-Simon (1760-1825), de Georg Wilhelm Friedrich Hegel (1770-1831), de David Ricardo (1772-1823) e de Charles Darwin (1809-1882), entre outros, foram o elo para que Alexis de Tocqueville (1805-1859), Auguste Comte (1798-1857), Karl Marx (1818 -1883) e Herbert Spencer (1820-1903), entre outros, desenvolvessem reflexões sobre a sociedade de seu tempo. Auguste Comte e Karl Marx foram os pensadores que lançaram as bases do pensamento sociológico e de duas grandes tradições – a positivista e a socialista – que muito influenciaram o desenvolvimento da Sociologia no Brasil. 1 AUGUSTE COMTE E A TRADIÇÃO POSITIVISTA Isidore Auguste Marie François Xavier Comte nasceu em Montpellier, na França, em 19 de janeiro de 1798. Com 16 anos de idade, ingressou na Escola Politécnica de Paris, fato que teria significativa influência na orientação posterior de seu pensamento. De 1817 a 1824, foi secretário do Conde de Saint-Simon. Comte declarou que, com Saint -Simon, aprendeu muitas coisas que jamais encontraria nos livros e que, no pouco tempo em que conviveu com o conde, fez mais progressos do que faria em muitos anos, se estivesse sozinho. Toda a obra de Comte está permeada pelos acontecimentos que ocorreram após a Revolução Francesa de 1789. Ele defendeu parte dos princípios revolucionários e criticou a restauração da monarquia, preocupando-se fundamentalmente em reorganizar a sociedade, que, no seu entender, estava em ebulição e mergulhada no caos. Para Comte, a desordem e a anarquia imperavam em virtude da confusão de princípios (metafísicos e teológicos), que não se adequavam à sociedade industrial em expansão. Era, portanto, necessário superar esse estado de coisas, usando a razão como fundamento da nova sociedade. Propôs, então, a mudança da sociedade por meio da reforma intelectual plena das pessoas. De acordo com o pensador, com a modificação do pensamento humano, por meio do método científico, que ele chamava de “filosofia positiva”, haveria uma reforma das instituições. Com a proposta do estudo da sociedade por meio da análise de seus processos e estruturas, e da reforma prática das instituições, Comte criou uma nova ciência, à qual deu o nome de “física social”, passando a chamá-la posteriormente de Sociologia. A Sociologia representava, para Comte, o coroamento da evolução do conhecimento, mediante o emprego de métodos utilizados por outras ciências, que buscavam conhecer os fenômenos constantes e repetitivos da natureza: a observação, a experimentação, a comparação e a classificação. De acordo com esse pensador, a Sociologia, como as ciências naturais, deve sempre procurar a reconciliação entre os aspectos estáticos e os dinâmicos do mundo natural ou, no caso da sociedade humana, entre a ordem e o progresso. O lema da “filosofia positiva” proposta por Comte era “conhecer para prever, prever para prover”, ou seja, o conhecimento é necessário para fazer previsões e também para solucionar possíveis problemas. A influência de Comte no desenvolvimento da Sociologia foi marcante, sobretudo, na escola francesa, evidenciando-se em Émile Durkheim e seus contemporâneos e seguidores. Seu pensamento esteve presente em muitas das tentativas de criar tipologias para explicar a sociedade. Suas principais obras são: Curso de filosofia positiva (1830-1842), Discurso sobre o espírito positivo (1848), Catecismo positivista (1852) e Sistema de política positiva (1854). Para concluirmos, Comte explanava que para a superação da anarquia reinante na nova sociedade industrial, a filosofia positivista defendia a subordinação do progresso à ordem. O mesmo era contra o retorno de Luís XVIII ao trono: em sua concepção, a sociedade industrial que emergia requeria um governo fundado na razão. 2 A TRADIÇÃO SOCIALISTA: KARL MARX E FRIEDRICH ENGELS Karl Heinrich Marx nasceu em Tréveris, na antiga Prússia, hoje Alemanha, em 1818 e, em 1830, ingressou no Liceu Friedrich Wilhelm, nessa mesma cidade. Anos depois, foi cursar Direito na Universidade de Bonn, transferindo-se para Berlim em seguida. Pouco a pouco, entretanto, seus interesses migraram para a Filosofia, área na qual defendeu, em 1841, a tese de doutorado A diferença da filosofia da natureza em Demócrito e Epicuro. Sua vida universitária foi marcada pelo debate político e intelectual influenciado pelo pensamento de Ludwig Feuerbach (1804-1872) e, principalmente, pelo de Georg Wilhelm Friedrich Hegel (1770- 1831). Friedrich Engels (1820-1895) nasceu em Barmen (Renânia), na antiga Prússia, hoje Alemanha, filho mais velho de um rico industrial do ramo têxtil. Terminou sua formação secundária em 1837 e a partir de então sua formação intelectual foi por conta própria (autodidata), com alguns cursos universitários esparsos e de curta duração. Desde cedo começou a trabalhar nas empresas de seu pai e foi nessa condição que se deslocou para Bremen por três anos e depois foi enviado pelos pais a Manchester, na Inglaterra, onde trabalhou nas fábricas da família. Engels ficou impressionado com a miséria na qual viviam os trabalhadores das fábricas inglesas. Os dois, Marx e Engels, se encontraram em 1842, quando Marx passou a escrever para A Gazeta Renana, jornal da província de Colônia, do qual Engels era colaborador e mais tarde editor-chefe. O jornal, que criticava o poder prussiano, foi fechado em 1843, e Marx se viu desempregado. Ao perder o emprego, mudou-se para Paris, na França. Ali escreveu, em 1844, os Manuscritos econômico-filosóficos (só publicados em 1932) e, junto com F. Engels, o livro A sagrada família. Por sua vez, F. Engels, em 1844, decidiu voltar para a Alemanha, onde publicou, em 1845, A situação da classe trabalhadora na Inglaterra. Entre 1845 e 1847, Marx exilou-se em Bruxelas, na Bélgica, onde escreveu A ideologia alemã (em parceria com Friedrich Engels) e Miséria da filosofia (1847), obra na qual criticou o filósofo Pierre-Joseph Proudhon (1809-1865). Em 1848, ainda na Bélgica, a parceria com Engels se solidificou ao escreverem juntos o livreto O Manifesto Comunista. Em 1848, Marx foi expulso da Bélgica e retornou a Colônia, na Alemanha (Prússia), sempre pensando na possibilidade de uma mudança estrutural em sua terra natal. Isso, entretanto, não aconteceu e Marx foi expulso da Alemanha em 1849, ano em que migrou para Londres, na Inglaterra, onde permaneceu até o fim da vida. Lá escreveu O 18 Brumário de Luís Bonaparte (1852), sua mais importante obra de reflexão sobre a vida política europeia do século XIX, desenvolveu pesquisas e concluiu seu maior trabalho: O capital: crítica da economia política. O primeiro volume dessa obra foi publicado em 1867; os outros três, em 1885, 1894 e 1905, após a morte de Marx, revisados por F. Engels. 2.1 O contexto histórico e a obra de Marx e Engels Para situar a obra de Marx e Engels, é necessário conhecer um pouco do que acontecia em meados do século XIX. Com as transformações que ocorriam no mundo ocidental, principalmente na esfera da produção industrial, houve um crescimento expressivo no número de trabalhadores industriais urbanos, com uma consequência evidente: precariedade da vida dos operários nas cidades. As condições de trabalho no interior das fábricas eram péssimas. Os empregados eram superexplorados, alimentavam-se mal e trabalhavam em ambientes insalubres. Para enfrentar essa situação e tentar modificá-la, os trabalhadores passaram a se organizar em associações e sindicatos e a promover movimentos de reivindicação. Desenvolveu-se, então, uma discussão das condições sociais, políticas e econômicas para se definirem as possibilidades de intervenção nessa realidade. Desde o início do século XIX, muitos pensadores discutiram essas questões, nas perspectivas socialista e anarquista. Na Inglaterra podem ser citados, entre outros: William Godwin (1756-1836), Thomas Spence (1750-1814), Thomas Paine (1737-1809), Robert Owen (1771-1858) e Thomas Hodgkin (1787-1866). Na França, destacaram-se Étienne Cabet (1788- 1856), Flora Tristan (1803-1844), Charles Fourier (1772-1837) e Pierre-Joseph Proudhon (1809-1865). Marx e Engels levaram em conta esses pensadores, debatendo com alguns contemporâneos e criticando-os. Além disso, incorporaram a tradição da economia clássica inglesa, presente principalmente nas obras de Adam Smith e de David Ricardo. Pode-se dizer, portanto, que Marx e Engels desenvolveram seu trabalho com base na análise crítica da economia política inglesa, do socialismo utópico francês e da filosofia alemã. Esses dois autores não buscavam definir uma ciência específica para estudar a sociedade (como a Sociologia, para Auguste Comte) ou situar seu trabalho em um campo científico particular. Em alguns escritos, Marx afirmou que a História seria a ciência que mais se aproximava de suas preocupações, por abarcar as múltiplas dimensões da sociedade, a qual deveria ser analisada na totalidade, não havendo uma separação rígida entre os aspectos sociais, econômicos, políticos, ideológicos, religiosos, culturais etc. O objetivo de Marx e Engels era estudar criticamente a sociedade capitalista com base em seus princípios constitutivos e em seu desenvolvimento, visando dotar a classe trabalhadora de uma análise política da sociedade de seu tempo. Assim, a tradição socialista nascida da luta dos trabalhadores, muitos anos antes e em situações diferentes, tem como expressão intelectual o pensamento de Karl Marx e Friedrich Engels. Para entender as concepções fundamentais de Marx e Engels é necessário fazer a conexão entre as lutas da classe trabalhadora, suas aspirações e as ideias revolucionárias que estavam presentes no século XIX na Europa. Para eles, o conhecimento científico da realidade só tem sentido quando visa à transformação dessa mesma realidade. A separação entre teoria e prática não é discutida, pois a “verdade histórica” não é algo abstrato e que se define teoricamente; sua verificação está na prática. Apesar de haver algumas diferenças em seus escritos, os elementos essenciais do pensamento de Marx e Engels podem ser assim sintetizados: • historicidade das ações humanas – crítica ao idealismo alemão; • divisão social do trabalho e o surgimento das classes sociais – a luta de classes; • o fetichismo da mercadoria e o processo de alienação; • crítica à economia política e ao capitalismo; • transformação social e revolução; • utopia – sociedade comunista. A obra desses dois autores é muito vasta e não ficou vinculada estritamente aos movimentos sociais dos trabalhadores. Pouco a pouco foi introduzida nas universidades como parte do estudo em diferentes áreas do conhecimento. Estudiosos de Filosofia, Sociologia, Ciência Política, Economia, História e Geografia, entre outras áreas, foram influenciados por ela. Na Sociologia, como afirma Irving M. Zeitlin, no livro Ideología y teoría sociológica, tanto Max Weber quanto Émile Durkheim fizeram, em suas obras, um debate com as ideias de Karl Marx. Pelas análises da sociedade capitalista de seu tempo e a repercussão que tiveram em todo o mundo, principalmente no século XX, nos movimentos sociais e nas universidades, Marx e Engels são considerados autores clássicos da Sociologia. No campo dessa disciplina, porém, o pensamento deles ficou um pouco restrito, pois perdeu aquela relação entre teoria e prática (práxis), ou seja, entre a análise crítica e a prática revolucionária. Essa relação esteve presente, por exemplo, na vida e na obra dos russos Vladimir Ilitch Ulianov, conhecido como Lênin (1870-1924), e Leon D. Bronstein, conhecido como Trotsky (1879-1940), da alemã Rosa Luxemburgo (1871-1919) e do italiano Antonio Gramsci (1891- 1937), que tiveram significativa influência no movimento operário do século XX. Com base no trabalho de Marx e Engels, muitos autores desenvolveram estudos acadêmicos em vários campos do conhecimento. At a time like ours when many African governments have failed in national develop ment, especially in their ability to improve the social welfare of her people through th e provision of social amenities like quality education, portable water, transportation, good roads, good medical amenities, security of lives and property, basic infrastructur e, etc., this work employs Igwebuike philosophy, another African category, as a framewor k for Africa’s development. It develops a model of development which is inclusive and wholistic, and traces Africa’s problem of underdevelopment to the employment of no n-inclusive political and economic institutions. Camus is considered to be (...) an existentialist, even though he firmly rejected the term throughout his lifetime. He is properly categorised as an atheist existentialist. However, he would also disagree with this label. In his notebooks, he presents the following contradictory statement: -/- “I do not believe in God and I am not an atheist.” -/- This reflects the notion of the Absurd. The search of the possibility of the existence of God is humanly impossible, but this also entails that the proof that God does not exist is impossible too. He writes in The Myth of Sisyphus: “In a universe suddenly divested of illusions and lights, man feels an alien, a stranger. His exile is without remedy since he is deprived of the memory of a lost home or the hope of a promised land. This divorce between man and his life, the actor and his setting, is properly the feeling of absurdity.” The Myth of Sisyphus is a fierce expression of the Absurd. Der Wissenschaftsphilosoph Holmes Rolston wies darauf hin, dass unsere „große Geschichte“ drei solcher Transformationen umfasst – wahre „Urknalle“.1 Die erste war der physische Urknall, der vermutlich vor etwa 13,8 Milliarden Jahren stattfand. Es gebar das manifeste Universum mit seinen Quantenteilchen, vielfältigen Arten von Energien und Milliarden von Galaxien. Es führte zur Bildung von Sonnensystemen mit Sonnen und Planeten und Energieflüssen, die die Entwicklung von lebenden (glücklich gelegenen) Planeten ermöglichen, die aktive Sonnen umkreisen. Eine weitere grundlegende Transformation – ein „zweiter Urknall“ – war die Entstehung lebender Organismen in den komplexen Systemen, die sich auf der Erde und vermutlich auch auf anderen Planeten entwickelt haben. Zu den evolutionären Vorteilen des weiterentwickelten Bewusstseins gehörte eine flexiblere und schnellere Form der Kommunikation. Die Kommunikation war nicht mehr auf halbautomatische Reaktionen beschränkt, die durch wiederkehrende Bedingungen und Ereignisse ausgelöst wurden; Anstatt sich auf Zeichen zu beschränken, basierte die menschliche Kommunikation auf einvernehmlich entwickelten Symbolen. -/- Die Entwicklung der Symbolsprache war ein großer Sprung. Einerseits brachte es soziale Strukturen hervor, die auf kollektiv erworbener Bedeutung beruhten, und andererseits produzierte es verbesserte manipulative Fähigkeiten. Gesellschaften könnten sich auf der Grundlage gemeinsamer Kulturen entwickeln, die mächtige Technologien einsetzen. Homo sapiens begann andere Arten zu dominieren und wurde zu einem Schlüsselfaktor in der Evolution des Lebens in der Biosphäre. Der dritte Urknall erzeugte eine Explosion der menschlichen Bevölkerung, aber er brachte nicht die Weisheit hervor, die sicherstellen würde, dass die erweiterte Bevölkerung das Gleichgewicht aufrechterhalten könnte, das für das Gedeihen des Lebens auf diesem Planeten unerlässlich ist. Der Aufbau unserer Herrschaft auf dem Planeten hängt davon ab, ob wir die Herausforderung dieser Transformation meistern. -/- Die erste und grundlegende Lektion ist einfach und offensichtlich. Wir haben uns von der natürlichen Welt getrennt und müssen zurückkommen – nicht um Wilde und „Primitive“ zu werden, sondern Wesen, die auf die Welt um sie herum eingestimmt sind, die im Einklang mit den Rhythmen und Gleichgewichten der Natur leben und kompatibel erschaffen und nachhaltige eigene Rhythmen und Balancen. Wir sind nicht mehr auf die Rhythmen und Balancen der Natur ausgerichtet. Obwohl wir durch unsere biologische Evolution in diese Rhythmen und Balancen „eingebaut“ sind, haben wir unsere eigenen künstlichen Rhythmen und gefährlichen Balancen geschaffen, die die natürlichen Rhythmen ignorieren und oft mit ihnen in Konflikt stehen. Mit der Sonne aufzugehen und sich mit der Sonne zurückzuziehen bedeutet, sich an den zirkadianen 24-Stunden-Rhythmus anzupassen, der durch die Bewegung der Erde um die Sonne geschaffen wurde, und die sogenannten primitiven Menschen leben immer noch in Harmonie damit, und das tun die meisten auch die restlichen indigenen und traditionellen Kulturen. Aber moderne Menschen missachten die Rhythmen und Gleichgewichte der Natur und glauben, dass sie sie ersetzen können, indem sie Lichter und andere künstliche Annehmlichkeiten mit dem Umlegen eines Schalters ein- und ausschalten. Doch der menschliche Körper passt sich nicht den künstlichen Rhythmen an, und wir leiden unter den Folgen. -/- 3Die Wirksamkeit des Immunsystems ist beeinträchtigt, und trotz einer Flut von biochemischen Medikamenten breiten sich Krankheiten aus. Moderne Bevölkerungen sind Stadtbewohner und haben nur begrenzten Kontakt mit der Natur. Sie leben in einer künstlichen Welt und denken, dass es die reale Welt ist. Sie halten sich anderen Lebensformen überlegen und glauben, die Natur nach Belieben beherrschen zu können. Noch vor fünfzig Jahren musste die Tierintelligenzforscherin Jane Goodall gegen die damals noch vorherrschende Überzeugung ankämpfen, dass ChiMenschen sind biochemische Reiz-Reaktions-Mechanismen, keine lebenden und fühlenden Wesen. Heute erkennen wir, dass nicht nur höhere Säugetiere, alle lebenden Organismen und sogar Bäume und Pflanzen sensible Lebewesen sind und sich in dieser Hinsicht nicht grundlegend von uns unterscheiden. Es liegt im besten Interesse unseres körperlichen und geistigen Wohlbefindens, dass wir diese Missverständnisse und fehlerhaften Verhaltensweisen korrigieren. Wenn wir dies tun, gewinnen wir unsere natürliche Gesundheit und Vitalität zurück. Die heilende Wirkung natürlicher Substanzen und Lebensweisen war schon in der Antike Heilern und Weisen bekannt. Seit Hippokrates, der als Vater der modernen Medizin gilt, suchen Mediziner nach Substanzen und Methoden, die das Gleichgewicht und die Verbindung zwischen Mensch und Natur wiederherstellen. Heute wird dieser Anspruch überschattet von einer oft kommerziell motivierten Abhängigkeit von synthetischen Substanzen und naturverachtenden Praktiken. Die Szene ist nicht nur negativ: Wie wir sehen werden, gibt es positive Entwicklungen in allen Bereichen des menschlichen Strebens, einschließlich Heilung und Medizin. Die Verbindung mit der Natur ist ein Hauptziel der alternativen Heilmethoden, die als Informations- und Energiemedizin bekannt sind. Diese Form der Heilung erlebt in verschiedenen Teilen der Welt, vor allem im Orient, eine Renaissance. Shirin yoku, die japanische Kunst des Waldbadens, ist ein Paradebeispiel. Um es zu praktizieren, müssen wir in einen Wald gehen und uns auf seine Rhythmen und Energien eingestimmt fühlen – den Wind durch die Blätter rauschen hören, das Lichtspiel auf der Oberfläche eines Teichs spüren, mit den Wolken schweben, wenn sie sich durch den Himmel bewegen. Psychotherapeuten finden, dass sogar die Geräusche der Natur, das Zwitschern der Vögel, das Rauschen der Bäche heilend wirken. Einfach in einem Wald zu sein oder neben einem Baum zu stehen, beruhigt und heilt das Nervensystem. Eine weitere wesentliche Aufgabe ist es, positive Entwicklungen in der Gesellschaft zu erkennen und daran anzuknüpfen. -/- Es gibt positive Entwicklungen in der Gesellschaft, und es gibt gesunde, lebensspendende und erhaltende Prozesse in der Natur. Wir könnten wieder in die Natur eintauchen und an positiven Entwicklungen in der Gesellschaft teilhaben. Und doch gelingt uns das nicht. Wir beschreiten einen Weg, der eher zum Zusammenbruch als zum Durchbruch führt. Wir müssen überdenken, wie wir gehen, und vor allem, wohin wir gehen. Wir sind eine von mehr als hundert Millionen Arten in der Biosphäre, wobei jede Art Millionen und in einigen Fällen Milliarden von Individuen umfasst. Unter all diesen Arten und Individuen befinden wir uns in einer privilegierten Position: Wir haben ein hoch entwickeltes Gehirn und Bewusstsein. Dies ermöglicht uns zu fragen, wer wir sind, was die Welt ist und wie wir in der Welt leben können und sollen. Ein fortgeschrittenes Bewusstsein ist eine einzigartige Ressource, und wir machen keinen guten Gebrauch davon. Wir stellen nicht die richtigen Fragen und suchen nicht nach den richtigen Antworten, sondern gehen einfach vorwärts und vertrauen auf das Glück. Wir haben unsere Zahl erhöht, aber nicht die Vorteile, die unser Bewusstsein denen verleihen könnte, die wir in die Welt bringen. Dennoch könnten wir die Lektionen lernen und unsere Wege korrigieren. Wir sind durchaus in der Lage, auf diesem Planeten zu leben, ohne das Gleichgewicht und die Ressourcen zu zerstören, die für ein gesundes Leben für uns und andere Arten erforderlich sind. Keine Spezies müsste dezimiert, unterworfen oder zum Aussterben getrieben werden, um uns am Leben zu erhalten. Wir könnten nachhaltig leben, mit anderen Arten koexistieren und die Grenzen des Lebens auf dem Planeten respektieren. Dennoch treiben wir unzählige Arten zum Aussterben und schädigen die gemeinsame Umwelt. Die bloße Tatsache, dass wir es geschafft haben, als biologische Spezies fünf Millionen Jahre und als bewusste Spezies fünfzigtausend Jahre zu überleben, ist ein Beweis dafür, dass unsere grundlegende Natur nicht das Problem ist. Es ist nicht die Masse der menschlichen Bevölkerung, die dafür verantwortlich ist, zu einer Geißel des Lebens auf dem Planeten zu werden, sondern nur ein Teil. Die Frage ist, warum dieses Segment unhaltbare und jetzt kritische Bedingungen für geschaffen hat die höheren Formen des Lebens auf der Erde? Und kann es sich rechtzeitig ändern und transformieren, um eine große Katastrophe zu vermeiden? Camus’ works delve into the human condition and the search for meaning in a seemingly indifferent universe. The Absurd and the Search for Meaning At the heart of Camus’ philosophy is the concept of the Absurd, which arises from the conflict between the (...) human desire for significance, order, and clarity on one hand, and the silent, irrational, and indifferent world on the other1. I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. This paper explores a middle way between realism and eliminativism about grounding. Grounding-talk is intelligible and useful, but it fails to pick out grounding relations that exist or obtain in reality. Instead, grounding-talk allows us to convey facts about what metaphysically explains what, and about the worldly dependence relations that give rise to those explanations.

Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

It is commonly assumed that grounding relations are asymmetric. Here I develop and argue for a theory of metaphysical structure that takes grounding to be nonsymmetric rather than asymmetric. Even without infinite descending chains of dependence, it might be that every entity is grounded in some other entity. Having first addressed an immediate objection to the position under discussion, I introduce two examples of symmetric grounding. I give three arguments for the view that grounding is nonsymmetric (I call this view (...) ‘metaphysical interdependence’). These arguments are: (i) that metaphysical interdependence is the only theory able to reconcile competing intuitions about grounding; (ii) that it is the only theory consistent with both ‘gunk’ and ‘junk’; and (iii) that offers a satisfactory solution to the problem concerning whether or not grounding is itself grounded. Attempts to elucidate grounding are often made by connecting grounding to metaphysical explanation, but the notion of metaphysical explanation is itself opaque, and has received little attention in the literature. We can appeal to theories of explanation in the philosophy of science to give us a characterization of metaphysical explanation, but this reveals a tension between three theses: that grounding relations are objective and mind-independent; that there are pragmatic elements to metaphysical explanation; and that grounding and metaphysical explanation share a (...) close connection. Holding fixed the mind-independence of grounding, I show that neither horn of the resultant dilemma can be blunted. Consequently, we should reject the assumption that grounding relations are mind-independent. (shrink)

Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. In industrial societies where civil law and state institutions have become well established secular vehicles for governing the populace, it is widely assumed that the state no longer has an interest in fortifying the religious sector as a complementary source of social control. Thus, a distinction is drawn between the Islamic state that is ruled by religious law and the secular state of Western industrial societies in which religion is deemed to have lost its influence in the public sphere. This (...) dissertation argues that civil law is not religiously neutral and thus challenges a central premise of secularization theory. Introducing a new theoretical model that classifies civil law on the basis of its purpose-to protect religious liberty, engage or fortify the religious sector, or to advance universal norms-the author examines the impact of the three different types of legislation upon religious freedom and the individual autonomy of religious minorities in Sweden, an aggressively secularized industrial society. The author concludes that, viewed from the standpoint of a religious nonconformist, there is no discernible difference between living in a society that is overtly ruled by religious law (e.g., an Islamic state) and living in a "secular” society that is ruled by civil law either embedded with religious norms or designed to facilitate state appropriation of the religious sector as a complementary means of social control. Zhuangzi suggests that death is a transformation that we commonly and mistakenly think means the end of someone but really just marks a new phase of existence. This metaphysical thesis is presented at several points in the text as an explanation of distinctively Daoist responses to death and loss. Some take a Daoist response to death, as presented by Zhuangzi, to indicate dual perspectives on friendship and death. But I argue that the metaphysical view sketched above is consistent with a (...) unified perspective, allowing the Daoist to enjoy deep friendships without risking some potential for grief typically associated with strong attachment. However, it leaves the Daoist best suited to friendships with those who endorse the same metaphysics. Furthermore, while the grief associated with the death of a friend is somewhat mitigated, the Daoist has reason to mourn even given this thesis. (shrink)

Philosophical food ethics or deliberative inquiry into the moral norms for production, distribution and consumption of food is contrasted with food ethics as an international social movement aimed at reforming the global food system. The latter yields an activist orientation that can become embroiled in self-defeating impotency when the complexity and internal contradictions of the food system are more fully appreciated. However, recent work in intersectionality offers resources that are useful to both philosophical and activist food ethics. For activists, intersectionality (...) provides a way to preserve and strengthen the meaningfulness of protest and resistance, even in the face of complexity and uncertain outcomes. For philosophers, intersectionality chastens the tendency to regard moral problems as inherently solvable, and provides a way use tensions inherent in food system reform as a source of ethical insight. Proprioception, a sense of bodily position and movement, is rarely the focus of conscious experience. If we are ordinarily conscious of proprioception, we seem only peripherally so. Thus, evidence that proprioception is present in the periphery of at least some conscious experiences seems to be good evidence that conscious experience is fairly rich. Anosognosia for paralysis is a denial of paralysis of one's limbs, usually in the wake of brain damage from stroke. Because anosognosic patients overlook their paralysis, anosognosia seems (...) be a counter-example to the claim that proprioception exists in the periphery of conscious experience. However, careful consideration of the data shows that anosognosia makes a poor counterexample to a rich theory of consciousness. Thus, we retain reason to believe that proprioception exists in the periphery of conscious experience, and so to conclude that conscious experience is relatively rich. (shrink)

The creation of complexity, which is necessary for the creation of life, is connected to the process of storing information in molecules of which the living cell is constituted. All living systems, either unicellular or multicellular organisms, are extremely complex systems compared to all the other species of the non living matter that exist in the Universe. Complexity is the result of effect processes, leading to systems with great organization, (...) containing large information stocks. This organization of the molecules of a living organism, a result of accumulation of information, is what makes them able to produce useful work. The useful work involves both the fulfillment of basic biological processes, such as metabolism and reproduction, and the further increase in the information content that builds up in living systems. This last process is subject to the great chain of evolution of biological systems, this development is governed by the law of natural selection. Έτσι, ενώ οι ρεαλιστές συγγραφείς του δέκατου ένατου αιώνα εργάζονταν για να κάνουν τις ενδεχόμενες λεπτομέρειες να φαίνονται απαραίτητες για το σύνολο του αφηγηματικού ιστού του μυθιστορήματος, η στρατηγική του Joyce, αντίθετα, είναι να θέσει σε κίνδυνο την ίδια την πιθανότητα της αφήγησης κάνοντας την ενδεχόμενη λεπτομέρεια σχετικά αυτόνομη, υποταγμένη στο τίποτα. εκτός από τη δική της (ποιητική) ύπαρξη. Το χρονικό της σκέψης’’ ονομάζεται μια συλλογή δοκιμίων και ομιλιών που γράφτηκαν και εκφωνήθηκαν στην Αθήνα, στο διάστημα 2010 με 2012. Αυτά τα κείμενα συνθέτουν μία ενιαία και πολυδιάστατη στοχαστική έρευνα που ιχνηλατεί τις εποχιακές μεταμορφώσεις του Χρόνου και της φιλοσοφικής Σκέψης. Οι σκέψεις που αναπτύσσονται, επιχειρούν να συναρτήσουν την Ιστορία με τη Φιλοσοφία, με διάθεση να διερευνήσουν το Αίνιγμα του Κόσμου που δεν είναι, αλλά ξετυλίγεται ως ανοικτός χωροχρόνος με τις σκέψεις που τον εκφράζουν, με τις γλώσσες που τον (...) ονομάζουν. -/- Στον πρώτο τόμο του έργου επιχειρούμε μια αναδίφηση στις απαρχές της Δυτικής Φιλοσοφικής Σκέψης. Στόχος μας ο διάλογος με τον αρχαιοελληνικό Λόγο (γλώσσα και σκέψη) και η αναβίωση του στοχαστικού ερωτήματος για το Άνοιγμα του Κόσμου, που έχει λησμονηθεί λόγω της κυριαρχίας του ανεξέλεγκτου ανθρωποκεντρισμού που σηματοδοτεί την τεχνο-επιστημονική εποχή σε όλες τις εκφάνσεις της. Αφετηρία της Δυτικής Φιλοσοφικής Σκέψης είναι η Σκέψη των αρχαϊ- κών χρόνων, η οποία εκφράζεται με τον Προσωκρατικό Λόγο που στο- χάζεται το Εν-Παν, με μυθολογικές ενοράσεις, διαισθήσεις και λογικές κατηγορίες. Ο Προσωκρατικός Λόγος αποτελεί φιλία για τη σοφία του Εν-Όλου που το φανερώνει στη γλώσσα. Η Σκέψη στους κλασικούς ελληνικούς χρόνους, ο αρχαιοελληνικός Λόγος (ως γλώσσα και νόηση), στοχάζεται την ένθεη φύση και τα όντα, το είναι ή και το γίγνεσθαί τους, αποτελεί φιλία για τη σοφία, έρωτα για το υπεραισθητό, ομολογία με την ιδέα. Ο Λόγος φωτίζει το είναι και το είναι του όντος, αγνοεί όμως το ομόλογο σκοτάδι «του», το μη είναι, τον ίσκιο του όντος.Η Σκέψη στους ελληνιστικούς χρόνους αποτελεί επανάληψη και ανανέωση της κλασικής ελληνικής σκέψης. Με τους Σκεπτικούς ο Λόγος αυτοεξετάζεται κριτικά, οι Στωϊκοί και οι Επικούρειοι αποζητούν να θεμελιώσουν την Σκέψη στην αυτοσυνείδηση. Ο Πλωτίνος με επιρροές από τη χριστιανική θεολογία εγκαθιδρύει το νεοπλατωνισμό. (shrink)

Despite the initial promise of social media platforms as a means of facilitating discourse on matters of civic discourse, in practice it has turned out to impair fruitful conversation on civic issues by a number of means. From self-isolation into echo chambers, to algorithmically supported filter bubbles, to widespread failure to engage politically owing to psychological phenomena like the ‘spiral of silence’, a variety of factors have been blamed. I argue that extant accounts overlook the importance of interpersonal relationships to (...) sustaining quality civic discourse on social media. Drawing on an Aristotelian account of friendship with an emphasis on the value of interpersonal difference plus the influence of interactions on individual character, I argue that a common scapegoat for the failure of civic discourse online—the variety of “unfriend” disconnection tools offered on various platforms—actually show promise at promoting better-quality civic conversation and overcoming the obstacles present on social media platforms. My alternative to representationalism is that each organism lives in its own "world" made up of objects defined by reference to the organism’s perceptual systems. El presente artículo analiza la etapa denominada arqueológica de Michel Foucault. Puntualizando principalmente cómo en esta etapa es entendido el concepto de libertad desde la noción foucaultiana de discurso. Se aborda, en este sentido, la etapa arqueológica de Foucault desde tres áreas. La primera, nos habla de cómo se erige lo diferente, lo anormal. La segunda, expone cómo se construye lo aparente, lo indiscutible. Por último, a partir de un marco teórico previamente expuesto, reflexionamos respecto del concepto de libertad.

Δύο επίμονα θέματα ζωντανεύουν όλη τη γραφή του Αλμπέρ Καμύ και αποτελούν τη βάση του καλλιτεχνικού του οράματος: Το ένα είναι το αίνιγμα του σύμπαντος, το οποίο είναι εκπληκτικά όμορφο αλλά αδιάφορο για τη ζωή. Το άλλο είναι το αίνιγμα του ανθρώπου, του οποίου η λαχτάρα για ευτυχία και νόημα στη ζωή παραμένει άσβεστη από την πλήρη επίγνωση της δικής του θνητότητας και της κυρίαρχης αδιαφορίας του περιβάλλοντός του. Στη ρίζα κάθε μυθιστορήματος, κάθε θεατρικού έργου, κάθε δοκιμίου, ακόμη και κάθε (...) καταχώρησης στα τετράδιά του βρίσκεται η αδιάκοπη ανάγκη του Καμύ να διερευνήσει και να προβληματιστεί για τον ειρωνικό διπλό δεσμό που αντιλαμβανόταν ότι ήταν η ουσία της ανθρώπινης κατάστασης: Ο άνθρωπος είναι προικισμένος με τη φαντασία να συλλάβει μια ιδανική ύπαρξη, αλλά ούτε οι συνθήκες, ούτε οι δικές του δυνάμεις επιτρέπουν την επίτευξή της. Η αντίληψη αυτού του απελπιστικού διπλού δεσμού έκανε αναπόφευκτη στον Καμύ την υποχρέωση να αντιμετωπίσει ένα κυρίαρχο ηθικό ζήτημα για τον άνθρωπο: Δεδομένης της περιορισμένης κατάστασης του ανθρώπου, υπάρχουν έντιμοι όροι με τους οποίους μπορεί να ζήσει τη ζωή του;.
